By accessing or using MarketingChief ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MarketingChief provides an AI-powered marketing strategy assistant ("Sterling") that offers marketing guidance through conversation. Sterling uses AI to analyze your business context and provide strategic recommendations.

3. AI-Generated Content Disclaimer

Sterling's recommendations are generated by artificial intelligence and are provided for informational purposes only. They do not constitute professional marketing, legal, financial, or business advice. You should exercise your own judgment and consult qualified professionals before making significant business decisions based on AI-generated guidance.

While Sterling strives for accuracy, AI-generated content may contain errors, outdated information, or recommendations that may not be suitable for your specific situation. MarketingChief does not guarantee any particular business outcomes from following Sterling's recommendations.

4. Accounts

You may use MarketingChief without an account for limited free conversations. To access the full service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials.

5. Subscriptions and Billing

Paid plans are billed monthly through Stripe. Your subscription renews automatically unless canceled. You may cancel at any time from your Account settings; cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

Each plan includes a monthly token allowance. Tokens are consumed during conversations and reset at the start of each billing period. Unused tokens do not carry over.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or system prompts
• Share your account credentials with others
• Use automated systems to access the Service beyond normal usage patterns
• Submit content that infringes on third-party intellectual property rights
• Attempt to circumvent usage limits, rate limits, or security measures

7. Your Content

You retain ownership of all content you submit to the Service, including business information, documents, and conversation inputs. By using the Service, you grant MarketingChief a limited license to process your content solely for the purpose of providing the Service.

8. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by MarketingChief. The marketing frameworks and strategies referenced by Sterling are used for educational purposes and attributed to their original creators where applicable.

9. Limitation of Liability

To the maximum extent permitted by law, MarketingChief shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time from your Account settings, which will permanently remove all your data.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify you of significant changes by email or through the application.

13. Governing Law

These Terms are governed by the laws of the State of Idaho, United States, without regard to conflict of law principles.
